In order to exercise their rights, Medicare beneficiaries must know their rights. Patients admitted to hospital inpatient services have the statutory right to appeal a discharge decision. Hospitals are required to inform them of this right by delivering the Important Message from Medicare (IM). In 2017, as the result of a focused review, Livanta QIO found that many hospitals are failing to do so properly because (1) there was no copy of the IM notice in the patient’s medical record, (2) the notice was not delivered timely and/or not documented correctly, and/or (3) the IM notice itself exhibited missing or incorrect information. These serious deficiencies may affect the well-being of millions of hospitalized Medicare beneficiaries.

Because of the substantial number of instances that Livanta QIO discovered when requirements were not met, Livanta QIO has developed an audit tool for use by hospitals that is available on request. Livanta QIO intends to continue its periodic IM compliance audits in its service areas. Any hospital found to have deficient performance can expect to receive a request for a Corrective Action Plan. Prevention is better than cure.
